Building & Construction

While it is recommended that you sign a written contract before having any work done on your property, you must have a written ‘major domestic building contract’ for work worth more than $10,000. This also applies if the contract has been split into several smaller amounts worth less than $10,000, as long as the full contract price is $10,000 or more.

At Ark Legal, we can provide independent legal advice before you sign your building contract, including checking for any clauses that unnecessarily limit your rights, ensuring that the builder is registered and insured, informing you of any additional council requirements for your local area and making sure you’re only liable to pay for work already completed. We can also assist with settling any disputes that arise with your builder (for example, relating to unlicensed works, property damage, or incomplete construction) or getting out of a building contract while minimising additional costs. We understand that litigation can be a challenging prospect – so we aim to resolve all disputes efficiently and without going to Court.

If you’re nearing the end of a property development, you will need to engage a lawyer to register your plan of subdivision with the relevant Titles Office and create your new titles. We will draft the appropriate paperwork to create the titles and owners corporation if applicable. We can also deal with mortgages by obtaining your bank’s permission to register the subdivisions.
